These Terms & Conditions apply to all purchases and custom-made orders made through By Aniek, available at byaniek.com.
By placing an order through our website, you acknowledge that you have had the opportunity to read and understand these Terms & Conditions.
1. ABOUT BY ANIEK
By Aniek is an independent fashion label specialising in vintage, reworked, one-of-a-kind and custom-made clothing.
Each piece is individually selected, designed, altered or created. Due to the nature of our collection, many pieces are unique and cannot be reproduced or replaced with an identical item.

2. PRODUCTS & PRODUCT INFORMATION
We make every effort to ensure that product descriptions, photographs, measurements and other information on our website are as accurate and complete as possible.
Please note that colours may appear slightly different depending on your screen settings.
Because many of our garments are vintage, pre-owned or made using previously used materials, each item may have its own individual characteristics.
Minor signs of age, wear, fading, irregularities or imperfections may be present. These characteristics are part of the nature and character of vintage and reworked clothing and do not necessarily constitute a defect.
We carefully inspect each piece and aim to mention any significant flaws or notable imperfections in the product description and/or photographs whenever reasonably possible.
Customers are encouraged to carefully review all photographs, measurements and product descriptions before purchasing.
3. ONE-OF-A-KIND & REWORKED ITEMS
Many products sold by By Aniek are one-of-a-kind.
Once a one-of-a-kind item has been sold, we may not be able to offer an identical replacement.
Reworked garments may contain materials originating from different garments, fabrics or previous uses. Small variations in colour, texture, stitching, construction and finish may therefore occur.
These characteristics are an inherent part of the design and nature of reworked clothing and should not automatically be considered defects.
4. CUSTOM-MADE & PERSONALISED ITEMS
By Aniek offers custom-made and personalised garments that may be created, altered or designed specifically according to a customer's individual measurements, specifications, preferences or requests.
Measuring process
For custom-made garments, a physical measuring appointment may take place where reasonably possible.
If the customer is located abroad or a physical appointment is not possible, the measuring process can take place remotely. Depending on the garment and the customer's situation, this may include a personal call or video call to discuss the required measurements and fit, a telephone or video appointment to guide the customer through the measuring process, or a measurement form provided by By Aniek specifying the measurements required for the particular garment.
When the customer is responsible for taking their own measurements, the customer is responsible for providing accurate and complete measurements and information.
If By Aniek requires additional measurements or clarification, the customer may be contacted before production begins.
Approval before production
Where necessary, By Aniek may confirm the relevant measurements, design details, materials or other specifications with the customer before beginning production.
Once the relevant specifications have been confirmed and production has started, changes to the design, measurements or specifications may not always be possible.
Any additional costs resulting from changes requested by the customer after production has started may be charged separately, where applicable.
Custom-made nature
Because custom-made garments are created specifically for an individual customer, they may be subject to statutory exceptions to the right of withdrawal where the applicable legal requirements are met.
Nothing in these Terms & Conditions limits any mandatory consumer rights that cannot legally be excluded.
5. ORDERS
An order is placed when the customer completes the checkout process and payment has been successfully received.
After placing an order, the customer will receive an order confirmation by email.
Because many of our pieces are unique, an item is only available for purchase while it remains available on our website.
In exceptional circumstances, By Aniek reserves the right to cancel an order if, for example, an item is found to be unavailable, damaged or incorrectly listed.
If an order is cancelled after payment has been received, the customer will receive a refund of the amount paid for that order.
6. PRICES & PAYMENT
All prices displayed on our website are stated in EUR and include applicable VAT where required by law.
Payment must be completed using one of the payment methods offered during checkout.
An order will not be considered complete until payment has been successfully received.
7. CUSTOMER RESPONSIBILITIES
The customer is responsible for providing accurate information necessary to complete an order or custom-made garment.
This includes, where applicable, correct contact information, measurements, design preferences and other specifications requested by By Aniek.
For custom-made garments, the customer acknowledges that the final result may be affected by the accuracy of the measurements and information provided.
If a customer provides incorrect or incomplete measurements or information, By Aniek cannot guarantee that the resulting garment will have the intended fit.
Where reasonably possible, By Aniek will communicate with the customer if information appears incomplete or inconsistent before production begins.
8. CHANGES TO CUSTOM ORDERS
Once production of a custom-made or personalised garment has started, changes may not always be possible.
If a change can be accommodated, additional costs may apply depending on the nature of the requested change, materials already used and additional work required.
Any such additional costs will be communicated to the customer before the additional work is carried out, where reasonably possible.
9. RIGHT OF WITHDRAWAL
The statutory right of withdrawal for online purchases and any applicable exceptions are described in our Shipping & Returns Policy.
Nothing in these Terms & Conditions is intended to restrict or exclude mandatory statutory consumer rights.
10. LEGAL GUARANTEE & CONFORMITY
Nothing in these Terms & Conditions affects the consumer's statutory rights.
Products must comply with the agreement and meet the requirements that consumers may reasonably expect from them.
For vintage and reworked products, the characteristics of the item that were clearly disclosed before purchase may be taken into account when determining what the customer could reasonably expect from the product.

Please provide your order number and a clear description of the issue.
We aim to respond to complaints as soon as reasonably possible and work with the customer towards an appropriate solution.
12. LIABILITY
By Aniek is responsible for fulfilling its obligations under the agreement in accordance with applicable law.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted by law.
By Aniek cannot be held responsible for circumstances beyond our reasonable control, including delays, disruptions or other circumstances outside our reasonable control.
13. INTELLECTUAL PROPERTY
All content published on byaniek.com, including but not limited to photographs, designs, logos, graphics, texts, product images and other visual material, belongs to By Aniek or is used with permission.
This content may not be copied, reproduced, modified, distributed or used commercially without prior written permission from By Aniek.
14. PRIVACY
Personal information provided during the ordering process is handled in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use, store and protect personal information.
15. CHANGES TO THESE TERMS & CONDITIONS
By Aniek reserves the right to update these Terms & Conditions when necessary.
The version applicable to an order is the version that was available at the time the order was placed.
The current version will always be made available on byaniek.com.
16. APPLICABLE LAW
These Terms & Conditions are governed by Dutch law, without prejudice to mandatory consumer protection provisions that apply to consumers in their country of residence.
Where a dispute cannot be resolved directly between the customer and By Aniek, the dispute will be handled by the competent court in accordance with applicable law.
